Qualified Person

In Australia, a Qualified Person or QP, is an individual specially accredited by IP Australia to certify new Plant Breeder’s Rights (PBR) applications.

Experts in specific plant groups, a QP is nominated by applicants to oversee the initial submission of their PBR application. A PBR cannot be processed without the involvement of a QP. 

The Role Of A QP

A QP provides valuable guidance and advice to anyone pursuing PBR. They also:

  • Supervise the growing trial
  • Verify the claims made and
  • Certify the application 

They also liaise with IP Australia to formalise aspects of the application, collect and collate data, submit detailed descriptions of your plant variety for publication in the Plant Variety Journal, and more.

Your QP is committed to overseeing the growing trial with utmost dedication. Their role is to ensure your trial is as robust as possible so you are able to obtain optimal protection through your PBR. 

How To Find & Nominate A QP

To find an accredited QP, you can check IP Australia’s online directory. You can refine your search by plant type and geographical region. 

If you are experienced in a specific plant category, you may like to consider becoming a QP yourself. You are permitted to oversee your own PBR application as an accredited QP. 

Once you have found the right QP for your situation, you can then nominate them as your chosen QP for the PBR process via this form
