Patent Application

A patent application is a formally prepared document that is submitted to a government patent office such as IP Australia. 

It seeks to establish the priority date of an invention and secure the exclusive rights to it through the granting of a patent. In Australia, a patent application must include several important documents outlining:

  • The ownership of the invention and the inventor's details such as their name, date of birth and postal address.
  • The details of the invention, describing it in detail and formatted in line with IP Australia guidelines. 

Filing 

You can prepare and file a patent application independently or with the help of a qualified patent attorney. 

The latter is recommended as this ensures all proper paperwork and novelty and patentability searches have been completed.

From the time of filing, patent applications can take upwards of 5 years to be accepted and registered, however, timeframes differ based on the actions of the applicant post-filing. Expedited processing can be requested under certain circumstances.
