Patent Family

A patent family is defined as a set of patents or a group of patent applications in several countries that all relate to the same invention. They are connected through priority claims, with familial links identified and confirmed at the time of filing.

While interrelated with a single invention at its origin, each patent in a patent family may differ slightly in what is protected or what claims are made. These differences may be required due to different legislation in each country.

Importance

Patent families are used to support priority claims and thereby protect inventions and their technical details from infringement.

Through a patent family, an inventor can apply for a patent for their initial invention followed by another for an improved invention when improvements are made.

This maintains a clear line of priority over the invention and ensures protection is upheld during the development of the idea. It also ensures different aspects of the invention can be found in a patent search and their related origins remain visible.
