Why Are Trade Mark Renewals Necessary?

Once registered, your trade mark is protected for 10 years, this time frame starts from the initial filing date. To maintain protection, a renewal request must be made at the end of this period.

Failure to renew will cause a lapse in protection, removing all rights acquired through the initial registration.

Following the renewal process keeps your trade mark in force, ensuring that you can uphold your rights and that you are best positioned to defend against misuse.

Should you delay the renewal of a trade mark and its registration lapses, you have a 6 month grace period in which to rectify the issue, after which your registration will be removed from record. To restore your rights a new application is required.

The Trade Mark Renewal Process

Trade mark renewals in Australia are handled by IP Australia, the governing body for trade marks, patents, design rights and copyrights.

A reminder notice for renewal will be sent two months in advance of the trade marks expiry, however, renewal can be initiated up to one year prior. There is no limit to how many times you can renew a trade mark.

Alongside the completion of the necessary paperwork, a renewal fee applies which is paid to IP Australia at the time of lodgement. IP Australia accepts trade mark renewals online, in-person or via post.

Each class associated with your trade mark attracts a fee and additional costs apply for late lodgements made during the grace period.

Is It Possible To Renew A Trade Mark Without Help?

It is possible to manage the renewal of your trade mark independently of any professional help. However, depending on your circumstances, this is not always the best course of action.

Errors in paperwork, missed deadlines or incorrect payment of trade mark renewal fees could see you lose the valuable protection afforded to you by your trade mark.

Having an expert onboard is the best way to avoid these mistakes and ensure that your rights are upheld both now and in the future.

For this reason, engaging a qualified trade mark attorney to handle your trade mark renewal is strongly recommended.
