What Is A Design Renewal?

Registering and/or certifying your design rights provides you with protection for five years from the date of the initial application.

After this period has passed, you then have the option to renew your design rights for a further five years - giving you a maximum of ten years of protection.

You may only renew your rights once and this must be done within the timeframe provided by IP Australia. Failure to renew on time may cause your design rights protection to lapse and be unable to be reinstated.

Design renewals are not compulsory. Should you elect not to renew, your rights will automatically lapse at the end of the renewal period.

The Design Rights Renewal Process

Two months before your design rights renewal is due, IP Australia will send a reminder notice to you via your nominated contact details. If you are using a patent attorney, this renewal may go directly to them.

Should you miss the initial renewal date, there is a 6 month grace period during which you can still renew your rights.

There is a fee associated with renewal and the amount varies depending on the method of renewal chosen. Additional charges apply for late renewals with the cost increasing with each month that the renewal fee is not paid.

Renewals are typically handled online through IP Australia’s online services portal or can also be requested by post. Online renewals offer immediate renewal confirmation and as such are the preferred method for most individuals.
